General Terms and Conditions
Rebeca van den Berg, Therapist
Registered office: Kanaalkade 57, 1811 LS Alkmaar, the Netherlands (the practice works online only) · Chamber of Commerce (KvK) no. 90824415 · Registered care provider (zorgaanbieder) under the Wet kwaliteit, klachten en geschillen zorg
Version 3.3, in force from 1 October 2026
These Terms are in English and are governed by Dutch law. Personal data is dealt with in the separate Privacy Statement, which forms part of these Terms.
Article 1 Applicability and acceptance
1.1 These Terms apply to every offer and every Agreement between the Therapist — Rebeca van den Berg, sole proprietorship (eenmanszaak), KvK no. 90824415 — and the Client, covering Sessions, Packages, Group Classes and Digital Products.
1.2 These Terms, the Privacy Statement and the Klachtenregeling are published on the website, where they can be read, saved and printed at any time. So that the Client also holds them in a form she can keep, these Terms and the Privacy Statement accompany the confirmation of purchase for a Group Class or a Digital Product, and the Client Agreement and Consent Form for individual therapy. For a Group Class or a Digital Product the Client accepts them at the moment of booking or purchase, and no signature is required. For individual therapy the Client accepts them by signing the Client Agreement and Consent Form.
1.3 Where these Terms and the Client Agreement and Consent Form conflict, whichever provision is more favourable to the Client prevails.
1.4 If any provision is void or annulled, the remainder stands. No provision operates to the detriment of a mandatory right of the Client under Dutch law; where it would, the statutory rule prevails.
Article 2 Nature of the services
2.1 The Therapist provides complementary therapeutic care directed at the emotional roots of the Client’s complaints, using TRG (Terapia de Reprocessamento Generativo / Generative Reprocessing Therapy) in combination with somatic and neuroscience-informed methods. A Session is an individual online consultation of sixty minutes, in English or Portuguese. The first Session under an Agreement lasts ninety minutes: the additional thirty minutes are used for the intake screening described in Article 4.2, and are not charged. A Package is a fixed number of Sessions purchased together at a single price. A Group Class is a scheduled online class for several participants, whether free of charge or paid. A Digital Product is a downloadable or pre-recorded product, such as an ebook or a self-paced course.
2.2 The Therapist is not registered under the Dutch Individual Health Care Professions Act (Wet BIG). She is not a psycholoog, psychotherapeut, psychiater or arts and does not hold herself out as such. She does not diagnose conditions, does not advise on medication or food supplements, performs no reserved medical procedure (voorbehouden handeling), and cannot issue a formal referral (verwijzing).
2.3 The services do not replace treatment by a general practitioner (huisarts), a psychiatrist or a mental health service, and are not reimbursed under Dutch health insurance. The Client is free at all times to begin, continue or end any other treatment, and the Therapist does not advise her to discontinue treatment received elsewhere.
2.4 The Therapist undertakes an obligation of effort and not of result (inspanningsverbintenis). No outcome is promised or guaranteed, in these Terms or in any other material of the practice.
2.5 The Client remains responsible for her own decisions, during the Agreement and afterwards.
Article 3 Scope of practice and exclusions
3.1 The Therapist works with adults aged eighteen and over, and does not work with minors.
3.2 The Therapist does not commence, and will discontinue, individual therapy where any of the following applies to the Client:
(a) current or recent suicidality or self-harm;
(b) psychosis, mania or significant loss of contact with reality;
(c) active addiction without concurrent specialist treatment;
(d) a severe eating disorder requiring medical monitoring;
(e) an ongoing unsafe situation, including domestic violence;
(f) an acute crisis requiring immediate clinical care;
(g) a need for psychiatric assessment or medication management.
3.3 The Client undertakes to answer truthfully and completely, to the best of her knowledge, the questions put to her at the introductory call and at the intake screening, and to tell the Therapist without delay if a circumstance listed in Article 3.2 arises later. A Client who discloses one is not disadvantaged by having done so.
3.4 Where the Agreement ends under this Article, Article 9.3 applies to the balance.
Article 4 Formation of the Agreement
4.1 For individual therapy the Therapist offers a free introductory call of approximately twenty minutes. It is not a Session and no therapeutic work is performed during it. During that call the Therapist goes through the exclusions in Article 3.2 with the Client. Where one of them applies, no Agreement is entered into and no payment is asked for.
4.2 The intake screening forms the first part of the first Session. The Therapist puts the intake questions to the Client and enters her answers in the screening record. It is for this reason that the first Session lasts ninety minutes while being charged as one Session.
4.3 Where no exclusion applies at the introductory call, the Therapist provides the Client Agreement and Consent Form after that call and before the first Session. The Agreement is formed when the Client returns that form signed and the Therapist accepts it, and the fourteen-day period in Article 6 runs from the day following that date.
4.4 For a Group Class or a Digital Product the Agreement is formed on completion of the booking or purchase.
4.5 The Therapist may decline to enter into an Agreement without stating reasons.
Article 5 Fees and payment
5.1 All fees are stated in euros and are the total amount payable.
5.2 For individual therapy, payment is made in full after the Agreement is formed and before the first Session, by the payment link provided by the Therapist, and not through the checkout on the website. For a Group Class or a Digital Product, payment is made before delivery. Payment in instalments may be agreed in writing.
5.3 The fee agreed applies for the duration of the Package; a change in rates takes effect only for Agreements concluded after that change. The Therapist confirms by email, in a form that can be saved, what has been purchased, the total amount payable, and the rates that apply to the recalculation in Article 9.3. Where the Client Agreement and Consent Form records an undertaking by the Therapist to hold her rates for later Packages, that undertaking binds her until the date stated there, including for Agreements concluded after the one in which it is recorded.
5.4 Where payment is late, statutory interest and collection costs may be charged only after a written reminder allowing the Client at least fourteen days to pay without further cost, and only on the statutory scale applicable to consumers.
5.5 Any refund under these Terms is made to the account from which payment was made.
5.6 Where payment in instalments is agreed, each instalment falls due before the Sessions it covers, and no Session is held before the instalment covering it has been paid. Where an instalment is not paid, the Sessions it would have covered are not scheduled and the validity period in Article 8.1 is suspended for as long as payment is outstanding; the Agreement is not thereby terminated. No interest and no fee is charged on an instalment plan.
Article 6 Right of withdrawal
This Article confers a right on the Client to cancel the Agreement and obtain a refund.
6.1 The statutory fourteen-day right of withdrawal applies to all services and products. The Client may withdraw within fourteen days of the day following the formation of the Agreement, without giving reasons; any clear statement to that effect suffices, including an email.
6.2 Sessions commence within that period only where the Client has expressly requested this in the Client Agreement and Consent Form. Absent such a request, the first Session is scheduled after the period has expired.
6.3 Where she has made that request and then withdraws within the period, she owes an amount proportionate to the part of the services already performed, calculated on the total price of the Agreement, and any balance is refunded within fourteen days of receipt of the withdrawal. The right of withdrawal lapses once all Sessions comprised in the Agreement have been performed.
6.4 For a Group Class the right lapses once the class has been delivered, and for a Digital Product once the Client begins the download or access — in each case only where she expressly requested performance within the fourteen-day period and acknowledged at that moment that her right would lapse. Where either the request or the acknowledgment is absent, the right of withdrawal is unaffected.
6.5 The model withdrawal form prescribed by law is set out in the Annex to these Terms, and is also available on the website. The Client may use it, but is not obliged to: any other clear statement of withdrawal is equally valid. Where the Agreement is concluded through the website, the Client may also withdraw using the withdrawal function on the website, and the Therapist confirms receipt without delay by email.
Article 7 Cancellation, rescheduling and non-attendance
7.1 Where the Client cancels or wishes to reschedule a Session:
(a) more than 24 hours before the Session: the Session is rescheduled free of charge;
(b) 24 hours or less before the Session, or where the Client does not attend: the Session is charged in full and is deemed to have been used.
7.2 The Therapist may waive or reduce that charge at her discretion.
7.3 Where the Therapist is more than fifteen minutes late, or the Session cannot proceed for reasons attributable to her, including her own illness, it is not deemed used and is rescheduled at no cost.
7.4 Where the connection fails, the parties attempt to reconnect for fifteen minutes. Failing that, the Session is not deemed used, unless more than half of the agreed time had elapsed.
7.5 A Session lasts sixty minutes, save for the first Session under an Agreement, which lasts ninety minutes. A Session ends at the scheduled time even where the Client joins late. Every appointment time agreed between the parties is stated in the time of the Netherlands (Central European Time, CET, or Central European Summer Time, CEST, when summer time is in force). The Client converts that time to her own local time.
7.6 For a Group Class, the Client may cancel her seat up to seven days before the class and receive a full refund, or transfer it to a later class. Inside seven days the seat is not refunded, but it may be transferred once to the next class. Where the Therapist cancels a class, every seat is refunded in full within fourteen days or, at the Client’s choice, transferred. This Article is without prejudice to the right of withdrawal in Article 6.
Article 8 Validity and rhythm of Packages
8.1 A Package is used within as many months as it contains Sessions (four months for a Package of four Sessions, eight months for a Package of eight Sessions), counted from the first Session or, where no Session has been held within one month of the formation of the Agreement, from the end of that month. That period is extended by any period during which the Therapist is unable to offer Sessions, including through her own illness or absence.
8.2 Where that period expires with Sessions unused, the Agreement ends, those Sessions can no longer be scheduled, and Article 9.3 applies to the balance. No Session that has been paid for is ever forfeited.
8.3 The work is offered at a weekly rhythm, and fortnightly is the practical minimum. This is a clinical expectation and not a payment condition. Where more than eight weeks pass without a Session and without an arrangement between the parties, the Therapist asks the Client in writing whether she wishes to continue. Where the Client does not reply within four weeks of that message, the Therapist may end the Agreement under Article 9.2, and Article 9.3 applies to the balance.
Article 9 Termination and settlement
9.1 The Client may terminate the Agreement at any time, with immediate effect and without stating reasons. No separate termination fee or notice period applies, and any balance is settled under Article 9.3.
9.2 The Therapist may terminate only for weighty reasons, which she states to the Client in writing. Weighty reasons include a circumstance listed in Article 3.2, a breakdown of the working relationship such that the work cannot safely continue, and the absence of any reply to the written enquiry described in Article 8.3.
9.3 How the balance is settled. Where the Agreement ends before every Session in a Package has been held, whichever party terminates and for whatever reason, save as (d) and (e) provide:
(a) the Sessions already held — including any Session deemed used under Article 7.1(b) — are recalculated at the rate the Client would have paid had she purchased only that number of Sessions: each Session held is charged at the per-Session rate of the largest Package whose number of Sessions does not exceed the number held, or at the single-Session rate where the number held is fewer than the number of Sessions in the smallest Package;
(b) the amount so calculated never exceeds the price the Client paid for the Package;
(c) the balance is refunded within fourteen days, to the account from which payment was made;
(d) where the Client withdraws under Article 6 within the fourteen-day withdrawal period, Article 6.3 governs instead of this Article;
(e) where the Agreement ends because a circumstance listed in Article 3.2 applies, whenever it arises, the Sessions already held are charged at the price per Session of the Package purchased (the Package price divided by the number of Sessions in it) and are not recalculated under (a).
9.4 The rates used for the recalculation are the Therapist’s published rates as at the formation of the Agreement.
Article 10 Change of country of residence
10.1 The Client informs the Therapist without delay of any change in her country of residence during the term of the Agreement.
10.2 Sessions, Packages, Group Classes and Digital Products are available to a Client wherever she is resident, unless the law of her country of residence does not allow the Therapist to provide them. A change in her country of residence does not in itself end the Agreement.
Article 11 Availability and emergencies
The Therapist does not provide crisis care and is not available outside working hours.
11.1 The Therapist does not monitor email, WhatsApp or any other channel during evenings, at night, at weekends or during periods of absence. She is not an emergency or crisis service and does not hold herself out as one.
11.2 The Client gives, in the Client Agreement and Consent Form, the name and telephone number of one emergency contact and of her own doctor. The Therapist makes use of either only in a situation described in Article 15.2.
11.3 The Therapist does not provide immigration, legal, financial or medical advice through any channel.
Article 12 Communication
12.1 All communication concerning the Client’s care, including forms and any information about her history or health, takes place by email to the address she has confirmed is hers alone, or by another method agreed in writing where she cannot safely use such an address.
12.2 WhatsApp is used for scheduling and practical matters only, and never for content concerning the Client.
12.3 Sessions are conducted by Google Meet. The connection is encrypted in transit but is not end-to-end encrypted. The Therapist does not record Sessions (Article 13.1).
12.4 Notice may be given to the Therapist by email to info@rebecavandenberg.com or by post to the registered office.
Article 13 Recording
13.1 The Therapist does not record Sessions. The Client may record a Session in which she takes part, for her own private use, but may not publish it or share it with anyone without the Therapist’s written consent.
13.2 A Group Class is not recorded by the Therapist, and participants may not record it.
Article 14 Testimonials and materials
14.1 The Therapist may invite the Client, at the end of the work, to provide a written account of her experience. Providing one is voluntary and is never a condition of the fee or of any reduced rate.
14.2 A testimonial is published only with the Client’s separate written consent, specifying the text and the name or initials under which it appears. Consent may be withdrawn at any time, and withdrawal changes nothing about what she has paid or will pay.
14.3 Worksheets, exercises, recordings, ebooks and course materials remain the Therapist’s intellectual property. The Client may keep and use them indefinitely for her own purposes, but may not publish, sell or distribute them.
Article 15 Professional secrecy
15.1 All information disclosed by the Client is confidential. The Therapist is bound by a duty of professional secrecy arising under artikel 7:457 BW, applying directly or by analogy under artikel 7:464 lid 1 BW or artikel 7:400 BW. Independently of that statutory duty, and whether or not it is held to apply to her practice, the Therapist binds herself by these Terms to observe professional secrecy on the same terms. She does not discuss the Client with the Client’s partner, family, employer or any other person without the Client’s written permission. This obligation continues after the Agreement has ended.
15.2 The Therapist may depart from Article 15.1 only in the following circumstances, and will inform the Client beforehand wherever it is safe to do so:
(a) where there is a serious and immediate danger to the life of the Client or of another person and no other means of averting it exists;
(b) where, having followed the steps of her reporting code on domestic violence and child abuse (meldcode huiselijk geweld en kindermishandeling), which the law requires her to have, the Therapist concludes that a report to Veilig Thuis is required because of acute or structural danger to the Client, to a child or to another member of the household. Consulting Veilig Thuis for advice without naming the Client is not a departure from Article 15.1;
(c) where the Therapist is obliged by law or by order of a court to provide information.
15.3 As the Therapist is not registered under the Wet BIG, she in all likelihood does not hold the legal privilege to decline to give evidence (verschoningsrecht) available to a medical practitioner. Should a court order her to give evidence concerning the Client, she may have no lawful means of refusing.
Article 16 The Client’s file
16.1 The Therapist is required to maintain a record of the services provided (dossierplicht), a separate file for each Client. How that file is kept and secured is set out in the Privacy Statement.
16.2 The file is retained for twenty years from the date of the last entry, in accordance with artikel 7:454 lid 3 BW, or as much longer as the care of a good hulpverlener reasonably requires. Where that provision does not apply directly to this practice, the Therapist applies it by analogy, whether under artikel 7:464 lid 1 BW or under artikel 7:400 BW, and observes the same period. Invoices are retained for seven years in accordance with Dutch tax law. These obligations survive the end of the Agreement and the closure of the practice, and do not affect the Client’s right under Article 16.3 to request destruction of her file.
16.3 The Client may inspect the file, receive a copy of it, have factual inaccuracies corrected, and have her own written statement added to it. She may request its destruction; the Therapist will comply save where a statutory obligation or a substantial interest of another person requires retention.
Article 17 Liability
17.1 The Therapist is not liable for consequences arising from information supplied by the Client which was materially incorrect or incomplete, where the Therapist could not reasonably have been aware of this.
Article 18 Complaints and disputes
18.1 The Client is invited to raise any dissatisfaction with the Therapist in the first instance.
18.2 Where the matter is not thereby resolved, the Client is entitled under the Wkkgz to the assistance of an independent complaints officer (klachtenfunctionaris), free of charge to her. That officer is provided by Quasir B.V. through the Klachtenregeling Zorg of ZZP Nederland, and may be contacted directly:
Quasir B.V., Afdeling klachtenbemiddeling · Postbus 1021, 7940 KA Meppel · bemiddeling@quasir.nl · 085-4874012 · www.quasir.nl
18.3 Where the Client is not satisfied with the Therapist’s decision, or where the Therapist fails to observe the complaints procedure, she may submit the matter to the independent disputes body to which the Therapist is affiliated, which decides by binding advice:
Stichting Zorggeschil · Postbus 132, 8430 AC Oosterwolde · ambtelijksecretaris@zorggeschil.nl · 085-273 32 19 · www.zorggeschil.nl
18.4 The written complaints procedure of the practice (klachtenregeling) is published on the website and provided on request, free of charge. It states the periods that apply, the costs of submitting a dispute, and how a complaint is handled.
18.5 Nothing in these Terms limits the period within which the Client may complain. The Client is free to bring the matter before a court instead of submitting it to Stichting Zorggeschil. Where Stichting Zorggeschil has given a binding advice, both parties are bound by it, and the Klachtenregeling sets out the limited route by which either of them may ask a court to set it aside. Complaints about the processing of personal data follow the procedure in the Privacy Statement.
18.6 Quasir B.V. and Stichting Zorggeschil work in Dutch, and the procedure is therefore conducted in Dutch. At every stage the Client may be assisted or represented by a person of her own choosing, including in translating or formulating her complaint, and may bring that person to a mediation meeting.
18.7 A Digital Product is not zorg, and the Wkkgz procedure in this Article does not apply to it. A purchaser of a Digital Product raises any complaint with the Therapist directly at info@rebecavandenberg.com, and retains the consumer rights available to her under the law of her country of residence. The practice is not affiliated to any consumer disputes body for Digital Products.
Article 19 Amendment, governing law and jurisdiction
19.1 The Therapist may amend these Terms in respect of Agreements concluded after the amendment. The version applicable to the Client is the one accepted at the formation of the Agreement, which is not altered during the term of her Package save where the law requires.
19.2 Dutch law governs the Agreement and these Terms. Where the Client is resident in another member state of the European Union, this choice does not deprive her of the protection of provisions of the law of her own country from which she may not be deprived by agreement. Where the Client is resident outside the European Union, Dutch law governs the Agreement and these Terms. Disputes may be submitted to the court that has jurisdiction under the law.
